Lawyers for Adnan Syed detailed the merits on which they plan to argue that Adnan Syed deserves a new trial in the killing of Hae Min Lee. As The Guardian points out, it looks like they were avid Serial listeners like the rest of us.
The 31-page filing, first flagged by Baltimore Sun reporter and Serial guest-star Justin George, was the first move in an appeal process that, if successful, would grant Syed a new trial.
According to the court filing, the lawyers will focus on the effectiveness of Syed’s lawyer, M. Christina Gutierrez. Attorney Justin Brown will argue that Gutierrez failed to properly investigate the alibi presented by Asia McClain. As Serial listeners know, McClain volunteered that she was in the Woodlawn Public Library with Syed at the time Lee was allegedly killed.
The lawyers also argue that Gutierrez didn’t broach a plea deal with prosecutors, and never asked Syed whether he was interested.
The filing calls the alibi Syed’s “best defense,” and says pursuing a plea deal is a “fundamental task.”
The state is due to respond to the argument by the end of April.
