Ohio Forced to Recognize Marriage of Gay Couple Wed at BWI, For Now

On July 11, Cincinnati couple Jim Obergefell and John Arthur flew out of their home state of Ohio (where same-sex marriage is banned by constitutional amendment), touched down at BWI Thurgood Marshall Airport, and were wed inside of their chartered plane. Their story has been made especially compelling by Arthur’s diagnosis of amyotrophic lateral sclerosis, a terminal disease.

Not two weeks have passed, and the two are making headlines again, as they have brought a lawsuit against Ohio to force the state to recognize their Maryland marriage. Citing Ohio’s record of recognizing out-of-state marriages between first cousins and minors (both of which are illegal there), U.S. District Judge Timothy S. Black ruled in favor of Obergefell and Arthur. The immediate practical implication is that Arthur’s death certificate will list him as married, and Obergefell will be named as his surviving spouse.

For as long as the Defense of Marriage Act was the law of the land, their marriage would have second-class status. So when the U.S. Supreme Court struck down Section 3 of DOMA in June, the two began to hatch a wedding plan, one made all the more urgent — and all the more complicated — by Arthur’s recent diagnosis of amyotrophic lateral sclerosis, a degenerative neurological disease.

Is the Supreme Court actually charging admission to witness legal arguments? No. It’s free. But given the historic nature of the debates over California’s gay-marriage ban and the federal Defense of Marriage Act, the high court’s ban on TV broadcasts of its cases, and the extremely low number of seats available to the general public (60 – 90!), waiting in line for a ticket has taken days. That’s a task some would rather pay others to do. And they’ve been paying them as much as $6,000 a seat.

You’re Invited to a “Big Gay Public Wedding”

Put it on your calendars now:  if you voted yes on Question 6, thus helping Maryland be one of the first states to legalize marriage equality by popular vote, then you’re invited to Chris and Shawn Riley’s “big gay public Maryland wedding” the second weekend of April 2013. A week before the election, Chris Riley told the internet that if Question 6 passed, he would “invite ANYONE that votes YES to my wedding ceremony.” He’s making good on that promise — so we have a feeling it’ll be a pretty crazy party.
